Terms of Service

1. Acceptance of Terms

By accessing or using Retly (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time — continued use after changes constitutes acceptance.

2. Description of Service

Retly provides automated marketing content generation for real estate professionals, including video slideshows, social media graphics, and related tools. The Service uses publicly available listing data from third-party APIs (such as Redfin via RapidAPI) and user-provided content.

3. Account Registration

You may use limited features as a guest. To access full features, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to create an account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on intellectual property rights
• Attempt to reverse engineer, decompile, or exploit the Service
• Use automated tools to scrape or extract data from the Service
• Misrepresent listing information in generated content
• Share account credentials with unauthorized parties

5. Content & Intellectual Property

Your Content: You retain ownership of content you upload (headshots, logos, branding images). By uploading, you grant Retly a limited, non-exclusive license to use this content solely for generating your marketing materials and displaying your agent profile.

Generated Content: Marketing content generated by Retly (videos, graphics, captions, descriptions) is licensed to you for use in your real estate marketing activities, including social media posting, listing presentations, and client communications. This license is non-exclusive and perpetual for content created during an active subscription. Free-tier content includes a Retly watermark that may not be removed without upgrading to a paid plan.

Music: Background music in videos is provided under royalty-free licenses. You may use rendered videos containing this music for commercial real estate marketing purposes. You may not extract, redistribute, or sublicense the music tracks separately.

Listing Data: Property listing data is sourced from third-party providers (including Redfin via RapidAPI). Retly does not guarantee the accuracy, completeness, or timeliness of this data. You are responsible for verifying all listing information before publishing. Retly is not liable for any inaccuracies in third-party data.

Social Publishing:When you authorize Retly to post on your behalf to Facebook or other platforms, you are responsible for ensuring that published content complies with those platforms' terms of service and your local advertising regulations.

6. AI-Generated Content Disclosure

Retly uses artificial intelligence and automated tools to generate marketing content, including but not limited to:

• Video slideshows with automated transitions and overlays
• Marketing descriptions and social media captions generated by AI language models
• Photo analysis and room-type labeling using AI vision models
• Automated graphics with text overlays

Your responsibility: Content generated by AI may contain inaccuracies, stylistic choices you disagree with, or information that does not reflect current listing status. You are solely responsible for reviewing all generated content before publishing or distributing it. Retly recommends reviewing every piece of AI-generated content for accuracy and compliance with your local MLS rules, fair housing regulations, and advertising standards.

Disclosure requirement:Depending on your jurisdiction and platform policies, you may be required to disclose that marketing content was created with AI assistance. We recommend including an “AI-assisted” or “Created with Retly AI” notice when publishing to platforms that require such disclosure.

7. Subscriptions & Billing

Retly offers free and paid subscription tiers. Paid plans (Agent and Office) are billed monthly through Stripe. All paid plans include a 14-day free trial. You will not be charged until the trial period ends. You may cancel at any time from your Billing dashboard or by contacting support.

Plan tiers and limits:

• Free: Up to 2 videos and 5 graphics per month, with Retly watermark. No social publishing or automation.
• Agent ($29–49/month): Unlimited videos and graphics, no watermark, social publishing, listing automation, priority render queue.
• Office ($99–199/month): Everything in Agent, plus up to 10 team accounts and API access.

Cancellation: Cancellation takes effect at the end of the current billing period. You retain access to paid features until then. After cancellation, your account reverts to the free tier. Previously generated content remains accessible.

Downgrades: If you downgrade from Office to Agent, team member access beyond the Agent limit will be removed at the end of the current billing period.

Failed payments: If a payment fails, your account enters a grace period during which you retain access to paid features. After repeated failures, your subscription may be suspended. You can update your payment method through the Stripe Customer Portal accessible from your Billing page.

Refunds: We do not offer automatic refunds. If you believe a charge was made in error, contact support@retly.ai within 14 days of the charge for review. Trial-period cancellations incur no charges.

Free trials: Trial periods convert to paid subscriptions automatically unless cancelled before the trial ends. You will receive an email reminder before your trial expires.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications at any time. We are not liable for any losses resulting from service downtime or data loss.

9. Limitation of Liability

To the maximum extent permitted by law, Retly and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may export your content before termination.

11. Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Massachusetts.
